Terms of Use
Version of 25 Aug 2026
This English translation is provided for your convenience and is intended to accurately reflect the German Terms of Use. In the event of any discrepancy, the German version shall prevail.
§ 1 Provider and scope
Terramio (terramio.app) is provided by Patrick Damm, Aachener Straße 638, 50226 Frechen, Germany, who can be reached at info@terramio.app. The full provider details are in the legal notice.
These Terms of Use apply to the use of Terramio. By registering, you agree to them. How your data is processed is described in the privacy policy; it is not part of these terms but a separate notice.
§ 2 What Terramio is
Terramio is a platform on which keepers of insects, arachnids and reptiles can document their animals and exchange ideas. Use is free of charge.
Terramio is at an early trial stage. Features may change or be discontinued, and outages and data loss may occur. There is no right to availability, to the continued existence of individual features or to the permanent retention of your content. Keep your own copy of any content that matters to you.
§ 3 Account and minimum age
An account is required to use Terramio. Registration is handled by our service provider Clerk.
You must be at least 16 years old. Anyone younger may only use Terramio through the account of a parent or another legal guardian; the account then remains the adult’s, and the adult is responsible for everything that happens through it.
Your account is personal. Do not share your login details, and do not let anyone act under your account. The information you provide when registering must be accurate.
§ 4 Your content
You may only upload images and videos that you have taken yourself or to which you hold all the necessary rights.
Other people’s photos and videos are not allowed – not even if they can be found freely on the internet, if the source is credited or if they come from a sales listing, a forum or a group. If other people can be recognized in a photo or video, you need their consent.
The same applies to text: descriptions and posts must be your own or be clearly marked as a quotation and be permissible.
§ 5 Rights of use to your images and videos
Your photos and videos remain yours. You merely grant us the right to display them within Terramio – a simple, non-exclusive right, without territorial restriction and only for as long as you keep the photo or video published.
This includes:
- display within Terramio, including overview and discovery pages,
- technically necessary processing, in particular creating reduced versions, thumbnails and other file formats,
- for content you make public: display as a preview image wherever the page is linked, for example in search engines or in the link preview of messaging apps. This is a consequence of publication and cannot be technically prevented.
Any further use is not included. In particular, we do not use your photos and videos for advertising, do not pass them on to third parties, do not grant sublicenses to anyone and do not use them outside Terramio. If we would like to use your photo or video beyond this, we will ask you first.
If you delete a photo or video or your account, the right of use ends. Backup copies that have already been made may persist for a short time; they are no longer displayed.
§ 6 Treating each other with respect
Treat other users decently. In particular, insults, harassment, threats, incitement against individuals or groups and publishing other people’s personal data without their consent are not allowed.
Also not allowed are illegal content of any kind, advertising and spam, and offers that violate species protection regulations.
Furthermore, attempts to scrape Terramio automatically, to circumvent the platform’s security or to overload it with excessive requests are not allowed.
§ 7 Reporting content
If you consider content on Terramio to be illegal – for example because it infringes your copyright – report it to us by email at info@terramio.app.
Helpful information includes: the address of the page concerned, a short description of the problem and, in the case of copyright infringement, an indication of how your authorship can be recognized. We look at every report and let you know how we decided on it. What a report should look like and what happens afterwards is described on our Report content page.
§ 8 Removal of content and suspension
If content violates these terms or applicable law, we may remove it. In the case of repeated or serious violations, we may suspend an account temporarily or permanently.
We announce the measure in advance where this is possible and reasonable, and we state the reason. In the case of a suspension, we always state the reason.
You can object to such a measure. To do so, write to info@terramio.app. We review the objection and lift the measure if it turns out to be unjustified.
Measures under this section are always decided by a person; we do not use automated content moderation. A measure is based either on the illegality of content or on a violation of these Terms of Use – there is no other reason. In each case, we choose the measure that is necessary to remedy the violation and let you know the reasons. If a measure turns out to be unfounded, we reverse it and let you know that as well.
§ 9 Termination
You can delete your account yourself at any time – via the profile button in the account area. Deletion removes your animals, terrariums, entries and photos and videos and cannot be undone.
We may terminate the user relationship with two weeks’ notice. The right to suspend under § 8 remains unaffected.
§ 10 Liability
Terramio is a platform for sharing experience. The content comes from other users and is neither veterinary advice nor an expert-reviewed husbandry recommendation. Whether a piece of information applies to your animal is something you must check yourself; if in doubt, consult a veterinarian. We do not vouch for the accuracy of user content.
We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the case of simple negligence, we are only liable if an obligation is breached whose fulfillment you may rely on and which is essential for the use of Terramio; in this case, liability is limited to the typically foreseeable damage. Mandatory statutory liability, in particular under the Product Liability Act, remains unaffected.
§ 11 Changes to these terms
We may change these terms, for example when features or the legal situation change. We will inform you of a change at least four weeks in advance by email to the address on file.
If you do not object before the change takes effect, the new version is deemed accepted; we will point this out again in the notification. If you object, you can continue to use Terramio under the previous terms until the change takes effect; after that, we may terminate the user relationship.
§ 12 Final provisions
German law applies. If you are a consumer, the mandatory protective provisions of the country in which you have your habitual residence remain unaffected.
The German version of these terms is authoritative.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
